You ("Your/You/ User/Member") to use the
products and services of the gayxi.com website (the "Site").
When registering as a Member, You agree to the Membership
Terms of Use and conditions ("Terms of Use/Conditions").
Please read the Terms of Use carefully before registering
Your User Profile. Any violation of the Terms of Use will
result in Your User Profile and Membership being terminated
without prior notice. |

Agreement to the terms of use |
1.1. You
are at least 18 years old.
1.2. When registering Your User Profile to become Member
of the Site, You will be asked to agree with the Terms of
Use.
1.3. You understand and agree that We reserve the right
to modify, block profile content, refuse and terminate membership
to anyone without prior notice.
1.4. the Terms of Use are subject to change without notice
at any time and at the sole discretion. Please check back
regularly for current updates on the Terms of Use.
1.5. Many of the products and services on the Site are available
to You free of charge. You may purchase an upgrade subscription
to receive extra features and facilties. Details can be
found on the Upgrade page after log in. |

Access and security |
2.1. Only
registered Members at least 18 years old may log in to the
User Profile section of the Site using a Username and Password.
2.2. You are solely responsible for the safekeeping and
confidentiality of Your password and should not disclose
it to anyone.
2.3. You may only create and maintain one (1) profile on
the Site. If multiple profiles are found for the same User,
then all the profiles for that User will be removed without
prior notice and future access will be blocked.
2.4. You are accessing the Site of Your own free will and
for Your own personal use only.
2.5. We strongly recommend that you do not disclose Your
password, personal information or address details while
using the products and services of the Site. Disclosing
any information to other Members is done so at Your own
risk. You agree to indemnify Us from all liability arising
from any information You disclose to other Members.
2.6. We strive to ensure a safe and secure Site environment
for Our Members. Please read Our Privacy
Policy for more information on the use and
safeguard Member data. |

| 3.
User code of conduct and photo policy |
3.1. Your
ability to contact and share information with other Users
on the Site with the least interference is very important
to Us. We are however obliged either by law or by our own
policies to actively monitor the flow of data between User's
and check all profiles on the site from time to time to
ensure that the Site remains within the law and in agreement
with the Conditions. By accepting these Conditions You agree
to the following code of conduct on the site:
3.2. You are not violating any law of Your country by accessing
the Site.
3.3. You understand that the Site may contain material that
may be considered objectionable and offensive.
3.4. You will only create one User profile.
3.5. You will not distribute any spam. illegal materials,
viruses or trojans to other Users.
3.6. You will not upload or transfer any information which
infringes patent, copyright or proprietary rights of any
party.
3.7. You will not solicit, advertise or offer any services
when using the the Site.
3.8. You will not threaten, harass, offend, impersonate,
swindle, annoy or cause anxiety of any kind to other Users.
Reported infringements of the code of conduct will be investigated.
We reserve the right to terminate, without notice, the membership
of User's who violate the code of conduct.
3.9. If you choose to communicate or meet any person(s)
as a result of information obtained on the Site, You do
so with Your own free will and hold the providers, owners
and creators of this Site harmless from any liability arising
from Your actions.
3.10. You understand that any profile not meeting all the
Conditions is subject to a written warning, suspension or
termination at the descretion. We are also be obliged to
report any suspected illegal use of the Site to the police
and authorities and will bring legal action against Users
who breach these Conditions or who are suspected of any
illegal activites.
3.11. Photo Policy: All
Your uploaded photos are screened and must comply to the
following criteria. Failure to do so will result in those
photos being removed from Your User profile:
3.11.1. No fully naked or sexually explicit photos.
3.11.2. No illegal or pornographic photos (including child
porn). These photos will be reported to the authorities.
3.11.3. No photos of violence or emotionally harmful to
others. |

Ownership of copyright and intellectual property |
4.1. All
content on the site, including text, graphics, images and
software are copyrighted by the Best Regards © 2005,
all rights reserved. All reproduction, distribution, modification,
retransmission, public display, and public performance of
such materials is prohibited without the prior written consent
of Best Regards. To obtain such consent, contact Us at info@gayxi.com.
4.2. You are not granted in relation to copyright, trade
marks or other of the intellectual property rights whilst
using the Site.
4.3. All other trademarks, trade names, service marks, service
names, product names and company names or logos cited herein
are the property of their respective owners. |

Site content |
5.1. By
using our products, services and content You are doing so
voluntarily for Your own personal use.
5.2. We check all User profiles and other Site content before
publication and reserves the right to remove and not to
publish information from Users or third parties which it
deems inappropriate, inaccurate or in breach of the Conditions.
5.3. We reserve the right to remove User images from the
Site which we deem inappropriate or offensive such as naked
images. We will report illegal images to the police and
local authorities.
5.4. We reserve the right to remove and rename Usernames
which we deem inappropriate or offensive. |

Limitation on liability |
6.1. We
strive to provide constant availability to the Site and
accuracy of the Site content. However, We do not warrant
no interruptions to the Site nor the provision of complete
and error free information.
6.2. In no event shall Best Regards and/or its directors,
employees or other representatives be liable to any User
for damages sustained to person or property as a result
of: (i) any omission or misrepresentation made on the Site
my Us or the Users of the Site, (ii) any defect in any information,
product or service provided or, (iii) any delay in provision
of an information, product or service arising from events
beyond our control including fire, flood, strike, terrorist
attacks, industrial action, war, civil unrest, accident,
technical or functional failure of infrastructure or goverment
intervention.
6.3. Due to required maintenance or technical failure, the
Site may be temporarily unavailable without notice.
6.4. You are solely responsible for any decision or action
you take based on the information contained on the Site.
6.5. Best Regards can be held responsible for the truthfulness,
completeness, reliability or accuracy of information provided
by Users or third parties on the Site. Neither do We make
no warranty or representation as to the quality of the products,
services, content posted or security of transferred information,
including virusses and other harmful programs.
6.6. The Site contains links to websites operated by other
parties. Best Regards has no control over such websites.
We are not responsible nor will we be liablie for the content
and performance of these Sites or for Your transactions
with them. Best Regards is providing these links to You
only as a convenience. the inclusion of links to such websites
